This limited warranty is extended by GAIA CO LTD, with its principal office at Gyeonggi-do, South Korea, to the original purchaser of a GAIA Truck Cap, GAIA Truck Camper, or GAIA Component.
Unless otherwise listed below, GAIA CO LTD, warrants its products, when purchased from an Authorized Dealer or Distributor, to be free from manufacturer’s defects for a period of two years from the date of purchase. During this period,GAIA CO LTD., through its Authorized Dealer or Distributor, will repair or replace at no expense to the limited warranty holder, any part found to be defective as a result of the manufacturing process (See HOW TO MAKE A CLAIM below).
GAIA CO LTD, does not warrant against defects resulting from shipping, improper assembly, installations, misuse, abuse, accidents, product modifications, negligence or deterioration of the finish due to improper maintenance or exposure to chemicals and/or other unusual environmental conditions. This warranty does not extend in any respect to accessories or parts not produced by GAIA CO LTD. and shall not extend to any consequential or incidental damages. This warranty is expressly in lieu of all other warranties expressed or implied, including the warranties of merchantability and fitness for a particular purpose and of all other obligations or liabilities on the part of GAIA CO LTD or GAIA Campers USA. GAIA neither assumes nor authorizes any other person to assume for it any other liability in connection with the sale of its products.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or limits on implied warranties, therefore the above limitations may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state. GAIA does not warrant any products purchased from unauthorized resellers, on 3rd Party Marketplaces, or in used condition. The warranty extends only to the original purchaser of the product through an Authorized Dealer or Distributor, and does not transfer to a new owner.
The limited warranty does not extend to normal wear and tear or damages resulting from improper use. It does not extend to damages during shipping which must be handled by the customer through a separate shipping insurance claim that is the sole responsibility of the customer. The following items limited to a warranty period of one year from the date of purchase at an Authorized Dealer or Distributor: 1) fabric components 2) rubber components 3) electrical components such as wiring, LED lights, or brake lights 4) latches, keys, locks, lock cylinders 5) hinges 6) gas struts 7) coatings, paint or powder coat 8)printed logos and logo nameplates. Consumable components such as removable rainfly, window stays (bows), clear vinyl window materials, and foam mattresses are not covered by this limited warranty. Cosmetic issues that do not affect the primary function of the product are not covered by the limited warranty. Examples of cosmetic issues include, but are not limited to 1) UV fade of paint or fabrics 2) minor paint or powder coating blemishes or minor scratches 3) minor dents in metal or composite panels 4) Additional examples of issues not covered under warranty include user error such as: 1) mildew or mold due to improper drying of the product after use 2) damage to door panels, hinges, latches, camper composite top panel etc from forcing them shut, or for attempting to store too many items inside the cap or camper which inhibit proper operation 3) camping in the rooftop tent in non suitable environmental conditions such as extreme cold (0 deg F or less), lightning, high wind (over 20mph) etc. 4) overloading of the product beyond rated load capacities (example putting too much weight on the roof rack, overloading of weight of gear or occupants inside the camper top, etc. Note that items stored inside the camper top also contribute to the overall weight of the installation on the vehicle) 5) failure to properly install, maintain, or secure the product to the user vehicle 6) failure to drive safely taking into account the new driving characteristics of the vehicle after the products are installed, both on or off highway 7)
The limited warranty does not extend to damage caused to the vehicle the Product is installed on, including but not limited to: 1) damage to the truck bed from bolts or clamps holding the product to the truck 2) damage to the vehicle, occupants, or other motorists due to loose mounting hardware or bolts which allows the product to shift or fall off the vehicle. Routine and proper maintenance and tightening of all hardware and mounting bolts is the sole responsibility of the user and GAIA CO LTD and its affiliates will not be held responsible.
It is the sole responsibility of the user to verify the overall installation meets applicable state and federal laws including 1) vehicle payload capacity 2) brake light size, brightness level, and location on the vehicle
The warranty is not offered by GAIA Authorized Dealers or Distributors, and all warranty resolutions (such as replacement parts, or authorization to perform repairs) must be provided by and authorized by GAIA CO LTD.
HOW TO MAKE A CLAIM:
To make a claim under this warranty, the party claiming must notify the Authorized Reseller from whom the product was purchased of the defect or malfunction. The Authorized Reseller will inspect the product and consult GAIA Campers USA to be covered by its warranty. To make a claim, use the online form found under the 'warranty claim' section on www.gaiacampersusa.com GAIA Campers USA will consult GAIA CO LTD and will send at no cost to the warranty holder the replacement part or parts necessary to correct the defect once they have been provided to GAIA Camper USA by GAIA CO LTD. Please allow sufficient time for the parts and materials to arrive in the USA from South Korea which may take months to arrive by ocean freight due to the physical size of the GAIA Products and components. If the problem is determined to be caused by improper use, improper assembly or installation, the Authorized Reseller, in accordance with his obligation to adhere to GAIA Camper USA's Reseller Agreement, will rectify the problem.
If you have purchased your GAIA product through a mail order or online fulfillment, or any other outlet which excluded the service of installation and have performed the installation as a do-it-yourself installer, you may, at GAIA Camper USA's option, be required to return the defective parts, properly packaged and at your expense to GAIA Camper USA's Warranty Department to the address provided by GAIA Campers USA (please include product I.D./Serial number and a description of the problem). If the part or parts are found to be defective, the replacement part or parts will be returned to you at our expense.
GAIA CO LTD maintains the highest possible standards of manufacturing and quality control. GAIA Campers USA expects its Authorized Reseller to adhere to a high standard when assembling and installing its products, and upholding this warranty.
